1. Introduction
This HR Concierge Service Policy (“Policy”) outlines the terms and conditions governing Tempfind Inc.’s (“Tempfind”) optional recruitment support service known as the HR Concierge Service (“HRC Service”). The HRC Service offers dental clinics (“Clinics”) personalized recruitment assistance in sourcing, vetting, and onboarding qualified dental professionals (“Professionals”) for short-term contracts, trial-to-hire engagements, and ongoing temp coverage.
The goal of this Policy is to ensure transparency, integrity, and legal compliance throughout the concierge recruitment process.
Note: For Clinics transitioning Professionals into long-term direct employment, this Policy works in tandem with the Direct Recruitment Policy, which outlines broader terms governing hiring practices on the Platform.
1.1. Relationship Disclaimer
Tempfind is a technology and facilitation platform and is not the employer of any Professional introduced through the Platform or the HRC Service. Unless expressly agreed otherwise, all Professionals introduced through Tempfind are deemed independent contractors or third-party service providers, not employees or agents of Tempfind. Clinics are solely responsible for ensuring compliance with all employment and labor laws related to their engagement.
2. Acceptance of Terms
By using the HR Concierge Service, both Clinics and Professionals agree to be bound by the terms of this Policy, as well as Tempfind’s general Terms of Use, Privacy Policy, and any other applicable agreements.
3. HR Concierge Process Overview
Tempfind’s HRC Service provides end-to-end support in sourcing and securing the right Professional for your clinic. The process includes:
3.1. Requirement Intake
Clinics submit a detailed description of the role, including job type, schedule, required credentials, and ideal candidate characteristics.
3.2. Candidate Screening
Tempfind’s Talent Team reviews the Clinic’s request and shortlists qualified Professionals from its pre-vetted talent pool.
3.3. Interview Coordination
Tempfind schedules and facilitates virtual or phone interviews between the Clinic and selected candidates.
3.4. Paid Trial Shift
Tempfind arranges a paid trial shift via the Platform, allowing both parties to assess fit before committing to longer-term engagement
4. Engagement & Billing Options
After a successful trial shift and final confirmation of the candidate, Clinics may choose one of the following two engagement models:
4.1 Direct Hire Option
- Agency Finder Fee: $2,750 CAD (non-refundable)
- The Clinic hires the Professional directly and becomes responsible for all employment terms, payroll, and HR compliance.
- The fee must be paid within 14 days of confirming the hire.
- This hiring arrangement is also governed by Tempfind’s [Direct Recruitment Policy].
4.2 Business Membership Plan
- Subscription Fee: $129/month CAD
- Once a Professional is selected following a trial shift, Tempfind will coordinate their schedule and assign them to all required future shifts as indicated by the Clinic.
- Clinics may book unlimited shifts per month with other Professionals using the Platform, without incurring additional placement fees.
- Shift hours are submitted by the Professional and confirmed by the Clinic.
- The Clinic’s credit card is billed via Stripe upon every shift completion and confirmation. A 2.9% + $0.50 transaction fee applies to each charge.
- Tempfind receives collected funds from Stripe on a weekly basis, after which Tempfind’s accounting department disburses Professional payouts weekly.
5. Non-Circumvention Agreement
To protect the value Tempfind provides, the following rules apply:
5.1. Clinics
Clinics may not offer, finalize, or suggest any direct or off-platform agreements with Professionals introduced through the HRC Service without notifying Tempfind and selecting the Direct Hire option.
Violation of this clause obligates the Clinic to pay the full $2,750 Agency Finder Fee immediately upon discovery. Tempfind reserves the right to suspend access or pursue legal or administrative remedies as needed.
5.2. Professionals
Professionals may not accept offers or agree to work directly with any Clinic introduced through the HRC Service outside of Tempfind, without prior written consent.
Violations may result in account suspension, removal from the platform, and potential legal consequences if revenue loss occurs due to circumvention.
This clause remains in effect for 12 months following the last shift or introduction facilitated by Tempfind.
6. Confidentiality
All information exchanged during the HRC process—such as candidate data, compensation details, and clinic requirements—must remain confidential between the Clinic, Professional, and Tempfind. Unauthorized disclosure is strictly prohibited.
7. Privacy and Data Protection
Tempfind complies with applicable privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA). Clinics agree to handle all Professional data in accordance with these standards and may not store or share any such data for purposes unrelated to the recruitment process. 8. Trial Shift Conduct & Responsibilities
Clinics are responsible for providing a safe, lawful, and professional environment during the trial shift.
Professionals must adhere to all applicable clinic policies and demonstrate professionalism at all times.
Any misconduct should be reported to Tempfind immediately for investigation.
9. Disputes and Investigations
Tempfind will investigate all disputes regarding shift hours, behavior, or payment discrepancies if the clinic chooses Business Membership rout. Final decisions will be made in good faith and at Tempfind’s sole discretion, based on the facts provided.
10. Limitation of Liability
To the fullest extent permitted by law, Tempfind and its affiliates shall not be held liable for any indirect, incidental, or consequential damages arising from the use of the HRC Service, including disputes, misrepresentations, or employment-related issues. Tempfind provides the service on an “as is” basis and makes no guarantees as to the outcome of any engagement.
11. Force Majeure
Tempfind shall not be liable for any delays or failures in service caused by events outside its control, including but not limited to natural disasters, acts of government, labor disruptions, pandemics, or third-party system outages (e.g., Stripe).
12. Governing Law
This Policy shall be governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising from this Policy shall be subject to the exclusive jurisdiction of the courts located in Toronto, Ontario.
13. Policy Updates
Tempfind may update this Policy periodically. Users will be notified of significant changes by email or via platform notifications. Continued use of the HRC Service constitutes agreement with the updated terms.
14. Appeals
If you wish to appeal any decision related to this Policy, please submit a written appeal within seven (7) days of receiving notice. Tempfind will review and respond to all appeals fairly and in good faith.
